Personal data protection policy

When browsing or creating an account on the Website, you are required to provide us with personal data concerning you which is collected and processed by CLIMAX.

Why are your personal data processed and for what purposes?

CLIMAX wants you to benefit from the best services and functionalities to give you access to a web-series accessible simply and smoothly according to your needs. To do this, we process in particular your data relating to your use of our Services in order to provide you with Services or to distribute suitable Offers to you or to measure the impact of our advertising campaigns which are presented to you.

What personal data do we process about you?

In particular, we collect and process :
- the personal data that you entered on our Website when creating your account (majority, password, location, email address and the data contained in the title of your email address). We specify that your password is encrypted and that we do not have access to it ;
- information relating to the orders you place on the Platform (Offer purchased, transaction number, etc.) ; 
- your payment information (payment method, credit card number, credit card expiry date, visual cryptogram) is not processed by CLIMAX but through a secure payment service provider, who has sole access to this data ;
- if you have accepted the registration of your bank card: the information relating to your bank card (name of the bank card holder, the last 4 digits of the bank card number and its expiration date) via a secure payment service provider, who has sole access to this data ;
- the information you send us when you contact customer service via our contact form contact@climax.how (content of the exchange, nature of the request, request for reimbursement, etc.) ;
- your connection and navigation data on the Website (IP address, offers and pages you have consulted or searched for, the Content that you have consulted and the information related to the consultation of the Content such as the number, the percentage of views viewed, etc.) ;
- data relating to the emails we send you for statistical and commercial prospecting purposes ;
- the information you provide when you leave a review on the Website ;
- information about our advertisements that you consult ;
- the information you provide when you participate in promotional operations, contests or events that we organize ;
- information when you choose to provide reviews or ratings, account settings or other information via our Service or elsewhere.

How long do we keep your data?

We keep your data in our database only as long as necessary for the fulfillment of those purposes and then archive it with restricted access for an additional period of time in order to fulfill our legal and/or regulatory archiving obligations and for the duration of applicable statute of limitations periods. At the end of this additional period, your data will be permanently deleted from our databases.

With regard to cookies placed on your terminal, they are kept for a maximum period of thirteen (13) months from the first deposit on the terminal.

To whom is your data transmitted?

Your personal data may be intended for our sub-processors who are involved in the provision of our Services (hosting of the Website and data, maintenance, sending of order confirmation emails, secure payment etc.) and, if necessary, to our business partners or third parties involved in the dissemination of advertisements (emailing, purchase of advertising space, etc.), subject to your rights guaranteed by the regulations applicable to the protection of personal data.

The sub-processors we use provide the guarantees required by the applicable regulations on the protection of personal data. They only have access to the data necessary for the performance of their services and are not authorized to process your data for other purposes. We also ensure that each of these sub-processors provide guarantees of security and protection of the integrity of your data and their processing in compliance with applicable regulations.

Where applicable, if you have previously consented to the commercial use of the data with our partners, we may also share user profiles with our commercial partners. These profiles could be defined according to your use of our Services and / or your interests. They are completely pseudonymized and do not allow you to be identified personally and are transmitted confidentially and securely. Thus, these profiles can be used by our business partners to establish, calculate or assume your interests and / or to offer you targeted advertising on their own sites and applications.

However, no sharing will be made if you have not previously consented to the placement of advertising cookies. You can withdraw your consent at any time by following the steps described in this “Do we use cookies?”.

Finally, personal data may also be communicated to public bodies, auxiliaries of justice, ministerial officers, in order to comply with any law or regulation in force, to which we are required to respond.

In the event of transfer outside the European Union, we operate in strict compliance with the protection conditions provided for by the applicable regulations.

What are your rights?

How to exercise your rights?

To exercise the rights indicated above, you can, subject to proving your identity, send us an email to the following address contact@climax.how in:

- stating the subject of your request and the right (s) you wish to exercise ; 
 - indicating your last name, first name;
- enclosing a photocopy of both sides of your identity card or passport, so that we can verify your identity.

CLIMAX will get back to you as soon as possible and at the latest within one month of receipt of your request.

CLIMAX undertakes to unsubscribe you from our mailing list as soon as possible.
